摘 要:
近年来,以生成式人工智能(Generative AI)为代表的技术迅速发展,其应用已渗透到音乐传播链条的多个环节,对音乐产业产生了深远影响。尽管人工智能为音乐产业带来了显著的生产效率提升、个性化分发和“全民创作”的机遇,但同时也衍生出亟待解决的法律伦理、著作权、人格权侵权等问题,包括人工智能模型训练过程中对版权音乐的使用是否构成侵权,人工智能生成音乐的可版权性及其权利归属,以及AI歌手对人类表演者声音权益的侵犯等。生成式人工智能与音乐产业的融合是技术与文化的双重变革,应当通过价值平衡和政策规制的协同治理,构建健全的法律与伦理框架,保障人类创作者的合法权益,从而促进人工智能技术在音乐产业中的应用与可持续发展。

Abstract: 
In recent years, technologies represented by Generative Artificial Intelligence (AI) have rapidly developed in the field of music, with their applications permeating multiple stages of the music communication chain and profoundly influencing the music industry. Although AI has brought significant improvements in production efficiency, personalized distribution, and opportunities for ‘creation by everyone’ to the music industry, it has also given rise to pressing issues concerning law, ethics, copyright, and personality rights. These include whether the use of copyrighted music for AI model training constitutes infringement, the copyrightability and ownership of AI-generated music, and the potential violation of human performers’ voice rights by AI singers. The integration of generative AI and the music industry represents a dual transformation of technology and culture. Through the coordinated governance of value balancing and policy regulation, it is necessary to establish a sound legal and ethical framework to safeguard the legitimate rights and interests of human creators, thereby promoting the sustainable and responsible development of AI technology within the music industry.
