中国电影分级制度构建问题研究

摘 要:
电影分级制度关乎我国电影市场的发展。目前我国电影方面的规范性法律文件中,虽有对电影可能引起未成年人观众身心不适提示的规定,但是缺乏对电影分级制度的规定。具体而言,在电影分级制度的具体判断标准、程序性事项以及救济程序方面尚未制定相关规定。对此,可参考比较法上日本和美国电影分级制度的立法经验,构建符合中国国情的电影分级制度。在立法上构建电影分级制度的实质和形式标准,明确分级标志和提示的形式,细化分级的主体和层级,建立相应的救济程序。从而完善我国电影分级方面的文化立法和制度建设。

Abstract:
The film rating system is crucial to the development of China's film market. At present, although the normative legal documents concerning films in China include provisions on giving warnings about content that may cause physical and psychological discomfort to minor audiences, they lack specific regulations on the film rating system. Specifically, relevant rules have not yet been formulated regarding the specific criteria for film rating, procedural matters, and remedy procedures. In this regard, we can draw on the legislative experience of the film rating systems in Japan and the United States from a comparative law perspective to establish a film rating system that conforms to China's national conditions. We should construct substantive and formal standards for the film rating system in legislation, clarify the forms of rating labels and warnings, specify the entities and levels of film rating, and establish corresponding remedy procedures. In this way, we can improve the cultural legislation and institutional construction related to film rating in China.
