相比于“色情内容”与“淫秽物品”，“擦边”行为的危害性与不法程度显然要低许多。依照《网络信息内容生态治理规定》第七条的类型划分，在当前网络使用环境中，它等同于“带有性暗示、性挑逗等易使人产生性联想的”内容，因而可被归类为“不良信息”。然而，对于具体哪些言语、动作、姿态或穿着触及“擦边”，进而需要被防范与抵制制作、传播，实务中却少有一套便于理解、可供对照、有据可循的评定细则。这就导致了如今平台方在相关审核与处置上有极大的裁量权，其间过程不透明、结果不确定、救济不充分，使得网络平台权力有扩张之嫌，对用户权益也有损害之虞。有鉴于此，在涉及“擦边”内容的治理上，网络平台应依照法规政策并结合实务经验，尽快制定详明的标准、尺度、细节、类型和参考范例。

Abstract:
Compared with "pornographic content" and "obscene materials", the harmfulness and illegality of Soft Porn is obviously much lower. According to the classification of domestic information management, in the current network usage environment, it is equivalent to "content with sexual innuendo, sexual provocation, etc. that can easily cause people to have sexual associations", and is therefore classified as "bad information". However, in practice, there is a lack of a set of easy-to-understand, comparable, and evidence-based assessment criteria for which specific words, actions, gestures, or clothing touch the "borderline" and need to be prevented and resisted from being produced and disseminated. This has led to the fact that online platforms now have great discretion in reviewing and handling soft pornographic content. At the same time, the process is very opaque, the outcome is uncertain, and the user's right to relief is not guaranteed. This has led to a significant expansion of the power of online platforms and has also caused great damage to the rights and interests of users. In view of this, the top priority for online platforms in governing content that "skirts the line" is to follow laws and policies and combine practical experience to quickly develop detailed standards, scales, details, types and reference examples internally.
